Guys, you don't have to come to talk to me when it looks like you're going to have a judgment taken against you. There are a fair number of board certified, av rated Arizona bankruptcy lawyers with high rankings on Avvo.com.
But come on.
Don't go see a general practice lawyer when you're panicked about insolvency issues.
I HATE it when I have to unwind a fraudulent transfer prior to a bankruptcy case, and I hate it even more when I'm told they only did it on their lawyer's advice.
If your lawyer told you to jump off a roof, would you do that?
Okay, so if your lawyer tells you to put your business, house, car, or Airedale Terrier in your girlfriend's, mother's, cousin's, or waitresses' name, don't do it!
Not unless the girlfriend, mother, cousin, or waitress pays fair market value and you actually receive the dough, and you use it to pay for food to feed your family or a roof to keep your children safe, with no bad intent, and you list it on your Statement of Affairs (p.s. keep a list of how you spent the proceeds)!
Makes for a lot more work, and it's a waste of lawyer time.
Do you think creditors were born yesterday? How about bankruptcy trustees?
And I persist: 99.99 of all debtors are honest folks who zigged when they should have zagged. And some just listen to lawyers who apparently went to law school on Neptune.
